In 2020 the IBA amended its Rules on the Taking of Evidence in International Arbitration. As is well known, the IBA Rules are among the most influential soft law instruments within the international arbitration community, together with the IBA Guidelines on Conflicts of Interest in International Arbitration.
The IBA Rules were drafted to bridge the gap between how evidence is treated in civil and common law systems. They have been used extensively and successfully in numerous international arbitrations (48% of the international arbitrations examined in the 2016 report on the reception of the IBA arbitration soft law products). The IBA Rules were initially drafted in 1999 and amended for the first time in 2010.
