With admirable frankness, the European Commission (EC) admitted in October 2003 that “we have never had a comprehensive reassessment of practice under article 82 in the light of economic thinking”. In July 2005, two external economist reports, commissioned by the Office of Fair Trading and the EC, recommended substantial changes to the law on abuse of market power.
The EC has said it will consult on draft guidelines later this year.
