On 31 May, Lord Nimmo Smith issued his judgment in McTear v Imperial Tobacco Limited, the first case in the UK to hear evidence on a claim against a manufacturer for the alleged health effects of smoking.
The 1,121-page judgment comprehensively rejected the pursuer’s case, holding that the pursuer “failed on every issue”.
