Scotland’s Court of Session has a thriving commercial court, enjoying a reputation for speed of progress and an attractive costs structure.

Further refinement to the conduct of commercial litigation in the Court of Session was implemented at the start of the year with new practice rules for commercial actions. These rules revoked rules in force for a decade. Those introduced the concept of the commercial court in that particular court. Pleadings are abbreviated and the case is managed proactively by the commercial court judges. Typically, one judge will see the case through to the end.
