With industry still coming to terms with the additional environmental requirements placed on it by the contaminated land and integrated pollution prevention and control regimes, a proposal for a new and controversial liability regime has recently been published by the European Commission.
The proposal for a directive on environmental liability was published in January this year and has been criticised by industry groups, amid concerns that if adopted, it will expose companies to unlimited claims for damage to biodiversity.
