Insurers Take Another Victory in COVID-19 Business Interruption Litigation

Another federal court has rejected the argument that the COVID-19 pandemic caused "direct physical loss or damage" to an insured's business. This decision is the latest in a series of cases where judges have come to similar conclusions.

Bad news for plaintiffs lawyers.

A federal judge in Pennsylvania entered an order in which he dismissed a significant portion of claims in a multidistrict litigation filed by 32 small businesses from across the country, who are seeking insurance coverage for losses they sustained during the pandemic.
