The Supreme Court of Washington, reversing lower court decisions in a lawsuit against a health insurer that denied coverage for proton beam therapy (“PBT”) to treat the insured’s prostate cancer, has ruled that the insureds established the existence of a genuine issue of material fact regarding PBT’s relative superiority to intensity-modulated radiation therapy (“IMRT”) to treat the insured’s cancer.
