Welcome to the Summer 2019 issue of the Insurance Coverage Law Report!
The issue begins with a “Feature” article on cyber insurance. The second “Feature” article in the issue discusses a case dealing with independent contractor classification. Our “Focus On” column explores coverage in wrongful conviction cases. And we have much more!
Cyber Insurance
As more companies purchase cyber insurance to protect against the risks of computer hacking and data breaches, the body of law interpreting these policies is evolving rapidly. Risk managers and counsel should monitor these developments as they determine the best available policy forms to meet their companies’ needs. In our lead “Feature” article, “Courts’ Approach To Cyber Insurance Continues To Evolve,” Mark A. Collins and Natalie Colvin, attorneys at McDermott Will & Emery LLP, compile many of the most noteworthy court decisions in this area.
Independent Contractor Classification
In our next “Feature” article, “Insurance Agent For Northwestern Mutual Found To Be Independent Contractor, Not Employee,” Alan J. Levin and Richard Reibstein, partners at Locke Lord LLP, discuss a favorable ruling for insurance companies on the issue of independent contractor classification. The court held that Northwestern Mutual Life Insurance Company had not misclassified as an independent contractor a life insurance agent who alleged that he was an “employee” under the New Jersey Wage Payment Law.

After a wrongfully convicted person is set free, governments and officials typically face lawsuits seeking damages – and typically turn to their insurers for coverage. In this issue’s “Focus On” column, “Coverage in Wrongful Conviction Cases,” Steven A. Meyerowitz, Esq., the Editor-in-Chief of the Insurance Coverage Law Report and the Director of the Insurance Coverage Law Center, discusses a decision that found coverage in a case stemming from a wrongful conviction of three men for a rape and murder. Not for the allegedly wrongful acts that sent these three men away, but for the horrible bodily injuries they suffered while there.
