Kansas Supreme: Law Capping Jury Awards for Noneconomic Damages in PI Cases Is Unconstitutional
The Supreme Court of Kansas has ruled that a Kansas law capping jury awards for noneconomic damages in personal injury actions was unconstitutional because it violated the “inviolate” right of trial by jury guarantee in Section 5 of the Kansas Constitution Bill of Rights.
