The U.S. Court of Appeals for the Eighth Circuit, reversing a decision by the U.S. District Court for the District of Minnesota, has ruled that, under applicable Wisconsin law, an insurance company could not rescind a disability insurance policy of an insured it claimed was over-insured because of his failure to cancel an existing policy at the time it issued its policy, as he had agreed to do.
