The U.S. Court of Appeals for the Sixth Circuit has affirmed a district court’s decision rejecting claims of female members of several Blue Cross Blue Shield of Michigan (“BCBSM”) health insurance plans that the insurer breached their contracts and denied them benefits in violation of the Employee Retirement Income Security Act of 1974 (“ERISA”), 29 U.S.C. § 1001 et seq., when it refused to pay for facility-based treatments for their eating disorders.
