A divided Missouri Supreme Court has upheld the dismissal of an action by patients alleging that they were damaged by multiple health services providers’ fraudulent billing scheme, finding that they had not shown that they suffered damages and rejecting the argument that they were damaged because they were subject to “potentially crushing legal liability” to their insurance companies to repay the overcharges that their insurers had paid.
