A Kentucky appeals court has reversed a punitive damages award against an insurer that was based on violation of the Kentucky Unfair Claims Settlement Practices Act (“UCSPA”) based on its conclusion that the insurer had no obligation to pay the insured’s claim and thus could not have violated the UCSPA.
