Dollar General Corp. claims its rival, Fred’s Inc., “unlawfully and deceptively” used its trademark black and yellow color scheme as well as a similar typeface in a new ad campaign.
In the suit, Nashville-based Dollar General claims Fred’s is in violation of its intellectual property rights, false advertising, unfair competition and violation of trademark and trade dress. The suit also claims the smaller retailer is engaging in unfair competition and is in violation of Tennessee’s Consumer Protection Act. Fred’s also is based in Tennessee.
