NASDAQ and the NYSE Euronext, the nation’s two largest stock exchanges, filed an amicus brief today with the U.S. Supreme Court in support of the Delaware Court of Chancery’s confidential arbitration program. The stock exchanges are the first companies to support the Chancery Court’s program through amicus briefs.

“Amici believe that Delaware’s confidential, expedited arbitration procedure is an important and beneficial ADR process that ensures that major United States and foreign companies choose to conduct business and list securities in the United States,” wrote Wilson Sonsini Goodrich & Rosati attorney and former Chancery Court Chancellor William B. Chandler III, who is representing both exchanges.
