The U.S. Supreme Court on Monday denied fossil fuel companies a writ of certiorari, sending environmental cases against them back to state courts in Delaware and New Jersey.

The denial is a win for the Delaware Department of Justice and the city of Hoboken, New Jersey, which claim more than 30 oil companies should be held liable for their contributions to climate change. It upholds the Third Circuit’s 2022 opinion finding the companies hadn’t met the high bar required for a defendant to remove litigation involving only state law claims to federal court.
