Vice Chancellor Nathan Cook struck down a new law allowing any Delawarean to vote by absentee ballot, finding the state’s constitution limits eligibility for mail-in voting to a specific set of circumstances.
In his first opinion for the Court of Chancery, Cook upheld another law passed this year, which allows same-day voter registration, stating the constitution doesn’t define when the voter registration period ends for a general election.
