An argument before the Delaware Supreme Court on Wednesday centered on whether New Castle County gave sufficient notice that a zoning permit had passed to trigger a 60-day limit on challenges.

Quinn Emanuel Urquhart & Sullivan partner Stephen Swedlow, representing herbicide company Croda Inc., said the wording the county used when publishing a notice in a newspaper was misleading, while Mary Jacobson argued for the county that Croda’s claims should have been brought within 60 days of the notice being published.
