McDonald’s can move forward with its case against its former CEO in Delaware, the Court of Chancery decided Wednesday.

Vice Chancellor Joseph R. Slights III denied a motion to dismiss the case, reasoning the agreement Stephen Easterbrook signed with McDonald’s when he was terminated in 2019 for having illicit relationships with employees didn’t specifically include clauses barring McDonald’s from filing a case against Easterbrook or requiring that case to be filed in Illinois, where the company is headquartered.
