Theories about how a data breach could cause harm in the future aren’t enough for a group of patients to proceed with their claims against a Wilmington medical office, a Superior Court judge ruled Thursday.

Judge Mary M. Johnston of the Delaware Superior Court wrote that her granting of Brandywine Urology Consultants’ motion to dismiss the case marks the first time a Delaware court has ruled on the issue of whether imminent future harm from a data breach is enough of an injury to qualify for standing.
