Morris James partner Brett D. Fallon moderated the American Bar Association business bankruptcy webinar titled “The Enforceability of Pre-Bankruptcy Agreements.”
Topics included: the enforceability of contractual constraints on filings, drafting operating agreements to protect LLC members from another member’s bankruptcy, contractual provisions triggered by bankruptcy, intercreditor agreements, reducing preference exposure and the treatment of trademark licenses.
Fallon has guided clients through the Delaware courts for over 30 years.
In his bankruptcy practice, he has represented creditors of all types, particularly large-dollar secured and unsecured creditors, creditor committees and both plaintiffs and defendants in post-confirmation actions brought by litigation and liquidation trustees.
In his corporate litigation practice, Fallon represents all parties in corporate, limited partnership and limited liability company disputes in the Delaware Court of Chancery. In his commercial litigation practice, he represents a wide variety of parties in commercial and contractual disputes in the Superior Court and the U.S. District Court.
