Equifax Inc. has moved to dismiss lawsuits brought over its 2017 data breach, insisting that no one was actually injured and that it owed no duty to safeguard the personal information of millions of consumers and financial institutions.

In a July 16 motion, Equifax attorney David Balser, a partner at King & Spalding in Atlanta, argued that claims brought by credit unions, banks and associations for financial institutions were based on an “attenuated theory of liability” that is unprecedented and “far-fetched.” And, in a June 27 motion, Equifax argued that a 566-page consolidated complaint on behalf of consumers was “long on words” but “short on operative facts.”
