The owner of a hotel near Turner Field will pay $1.17 million to a would-be guest who was shot in the stomach while attempting to check in.

A Clayton County State Court jury reached a $3.68 million verdict last month on claims the hotel provided negligent security. The jury apportioned the responsibility for the damages at 58 percent for the shooter, who wasn’t a defendant in the suit; 32 percent on the defendant hotel owner and 10 percent on the plaintiff himself.

After the verdict was read, the plaintiff’s lawyers told Judge Aaron Mason they planned to seek an additional award for attorney fees. The opposing sides made a deal 20 minutes later, with the defense agreeing to pay the hotel’s $1.17 million share of the verdict in exchange for the dismissal of the fee case, according to plaintiff’s attorney Lloyd Bell of Bell Law Firm. He and Julian Sanders of Sanders Law Group and Michael Watson of the Bell firm represented Heinz Fojutowski, now 44, who suffered disabling injuries from the shooting and still leans on a cane to walk.
