Post-trial action in a $9.2M medical malpractice verdict out of a Macon court is reflecting an emerging trend in verdict remittal arguments.

After the McArthur and Dellaconca law firms successfully secured a plaintiffs’ win in a medical-malpractice and wrongful death action, the defense, represented by a team including Austin Atkinson, Brent Hyde, Jacquelyn Smith Clarke and Michael Profit of Hall Booth Smith and Bob Marcovitch of Sinton Scott Minock Kerew, petitioned the trial court for a new trial and to remit the $7,216,500 awarded for the life of a deceased patient to a wrongful death award cap of $350,000.
