During oral arguments on Wednesday, former Fulton County Probate Court Judge Floyd Propst asked the Georgia Court of Appeals to weigh whether a funeral home has a good faith obligation to contact out-of-state next of kin before determining what to do with a body.

The question came on behalf of plaintiffs appealing a DeKalb County State Court summary judgment in favor of a funeral home that cremated a body without—allegedly—attempting to seek out the deceased’s next of kin.
