Andy Rogers and Kara Phillips of Deitch & Rogers in Atlanta have secured a $3.8 million verdict in DeKalb County State Court for a premises liability case brought by woman who was sexually assaulted in the fitness center of her apartment complex.
They told the Daily Report in an interview Monday their client was attacked after her workout as she was leaving the gym. Because it was after dark, she was visible from the outside while she was inside in the lighted room with windows, with no clue she was being watched. They produced evidence of previous reports of burglary, armed robbery, auto theft, forced entry and indecent exposure on the property and said management failed to warn or provide security to residents.
