An Atlanta prosecutor who failed to cancel a witness warrant, leading to that witness’ arrest, isn’t entitled to immunity from a lawsuit, a federal appeals court ruled Monday.

Antoinette Stephenson, an assistant district attorney in Fulton County, obtained a witness warrant requiring taxicab driver Kidanemariam Kassa to appear as a witness at a trial for an attempted robbery he was the victim of. But Kassa appeared voluntarily, and Stephenson didn’t make an oral motion asking the judge presiding over the case to recall the warrant. He was arrested and in jail for six days before a judge ordered his release.
