A Georgia man who linked his cancer diagnosis to decadeslong use of a Roundup herbicide is getting another chance at holding the product’s manufacturers accountable under state law.

The U.S. Court of Appeals for the Eleventh Circuit issued a reversal in favor of plaintiff John Carson after determining federal law did not shield manufacturer Monsanto Co. from Carson’s state law failure-to-warn claim linked to the product’s labeling. Monsanto is a subsidiary of Bayer AG, one of the largest pharmaceutical companies in the world.
