In a time where mental health and psychological well-being are top of mind, the question of psychological damages allegedly stemming from work is a fair one as it relates to workers’ compensation.

Under Georgia law, a claimant must prove he or she sustained an injury arising out of and in the course of the employment to recover workers’ compensation benefits. The courts have construed a compensable “injury” under O.C.G.A. § 34-9-1(4) as “a discernible physical injury.”
