The wife of an elderly man struck and killed by a service van while crossing a street near Kennesaw State University north of Atlanta last year has settled her claims against Reliable Heating & Air and its driver for $1 million.

The settlement comes in case involving what plaintiff’s attorney Darren Tobin, principal of Tobin Injury Law, described as potentially perilous facts for both his client and the defense: The victim, Kap Suh, was an 86-year-old Korean immigrant who was in a crosswalk when struck, but the driver—who had stopped for a red light—apparently hit him after the light turned green.
