Lawyers for a man injured when an Atlanta Police officer fired into a moving vehicle said a decision by the U.S. Eleventh Circuit Court of Appeals reversing a district court’s dismissal of the case clearly showed that the trial judge overstepped his bounds in granting summary judgment to the city, even as he conceded that their client’s constitutional rights had been violated. 

The panel ruling by Circuit Judges Charles Wilson, Beverly Martin and Robin Rosenbaum agreed that plaintiff Demetric Favors’ rights had been violated when he was shot in the leg while a passenger in a car leaving a downtown strip club.
