As the world reflects on the storming of the U.S. Capitol, the question arises whether President Donald J. Trump could be charged with inciting a riot. He certainly urged the crowd at the Ellipse, a park near the White House, to march down Pennsylvania Avenue to the Capitol.

During his one-hour address, according to multiple media outlets, he said , “I’ll be there with you,” “We fight like Hell,” “You’ll never take back our country with weakness,” “If you don’t fight like Hell, you’re not going to have a country anymore,” and “We will never give up, we will never concede.”  And, of course, he persisted in his assertion that the election was stolen from him.  In the lead up to the event, he tweeted, “Big protest in D.C. January 6th.  Be there, will be wild!”
