Even though President Donald Trump commuted the 20-year prison sentence of Philip Esformes—the one-time operator of a string of Miami assisted-living and skilled nursing facilities—Esformes’ battle to dismiss the case against him isn’t over, his Atlanta appellate lawyer says. 

Esformes was released from prison within 24 hours of Trump’s Dec. 22 decision to grant him clemency in what federal prosecutors once branded as “the largest health care fraud scheme ever charged by the Department of Justice.”
