Georgia Supreme Court Justices Charles Bethel and Nels Peterson have recused from a case challenging a 30-year tax break for the owners of the Atlanta Falcons’ Mercedes-Benz Stadium, but three more—Presiding Justice David Nahmias and Justices Michael Boggs and Sarah Warren—have refused to exit the case after their recusals were also sought.

The plaintiffs are a group of Fulton County taxpayers aiming to upend the 2013 deal they estimate will cost the county $800 million over the life of the ad valorem tax abatement.
