A divided Georgia Court of Appeals panel upheld a trial judge’s dismissal of claims that instant messaging app Snapchat’s “Speed Filter” was to blame for a wreck that left a man gravely injured by a teenage driver trying to record herself driving 100 miles an hour in her father’s Mercedes.

The lawsuit had already been tossed once, only to be revived by the appellate court two years ago, but on Friday Presiding Judge Sara Doyle wrote that Snapchat could not be held liable for the plaintiff’s injuries “because, based on the facts of this case, the allegedly negligent design claim does not fall within Snapchat’s duty of care to the plaintiffs.”
