A plaintiff in an Engle progeny case will get a second chance at a $15 million lawsuit against R.J. Reynolds Tobacco Co. and Philip Morris USA Inc. after the Fourth District Court of Appeal reversed in her favor.
Fannie Collar, who started smoking at age 12 and continued after removal of a cancerous lung, won on appeal in a case that turned on questions of addiction and motivation to quit. She will get a new trial to adjudicate claims the defendants’ products caused her pulmonary diseases.
