To Amend Board Policies 7530.01, Staff Use of Wireless Communication Devices, 7540.03, Student Responsible Use of Technology, Social Media, and District Network Systems & Internet Safety, and 7540.04, Staff Responsible Use of Technology, Social Media, and District Network Systems. Board Policies 7530.01, Staff Use of Wireless Communication Devices, and 7540.04, Staff Responsible Use of Technology, Social Media, and District Network Systems, are proposed for amendment to incorporate the requirements of F.S. 112.22. Board Policy 7540.03 is proposed for amendment to incorporate the requirements of F.A.C. 6A-1.0957. Board Policies 7530.01, Staff Use of Wireless Communication Devices, and 7540.04, Staff Responsible Use of Technology, Social Media, and District Network Systems, are proposed for amendment to incorporate the requirements of F.S. 112.22, which requires that public employers restrict access to any prohibited application on a government-issued device, prohibit such applications from being downloaded, and have procedures in place to remotely wipe and uninstall any prohibited application from a government-issued device that is believed to have been adversely impacted, either intentionally or unintentionally, by a prohibited application. Policy 7540.03 is additionally proposed for amendment as a result of F.A.C. 6A-1.0957 (Aug. 22, 2023), which requires staff to confirm that online content is not blocked by the District’s student internet filter before requiring students to access that content. The rule additionally requires that the Board’s internet safety policy be reviewed and approved annually.

To Amend Board Policies 8405, School Safety, 8410, Emergency Management, Preparedness & Response, and 2410, School Health Services, and to adopt a new Policy 2410.01, Mental Health Services. Board Policies 8405, School Safety, and 8410, Emergency Management, Preparedness & Response, are proposed for amendment as a result of State Board of Education Rules 6A-1.0018 and 6A-1.0019 (Sept. 26, 2023). Policy 2410, School Health Services, is proposed for amendment to move language regarding mental health services into a new Policy 2410.01, which also adds the requirements of F.S. 1006.041. Board Policies 8405, School Safety, and 8410, Emergency Management, Preparedness & Response, are proposed for amendment to incorporate the new requirements of State Board of Education Rules 6A-1.0018 and 6A-1.0019 (Sept. 26, 2023). Policy 8405 is proposed for amendment as a result of Rule 6A-1.0019, which requires that the District move from the current Comprehensive School Threat Assessment Guidelines ("CSTAG") model to the "Florida Harm Prevention and Threat Management Model" by January 1, 2024. Policy 8410 is proposed for amendment as a result of Rule 6A-1.0018, which requires that the District provide after-action reports after emergency or fire drills. Policy 8410 is also proposed for amendment in response to Board action to require that the District’s Emergency Operations Plan include procedures for responding to alerts or reports of lightning. Board Policy 2410, moreover, is proposed for amendment to have mental health services addressed in a new Policy 2410.01, which also incorporates the requirements of F.S. 1006.041.

Policies 1210, 3210, and 4210, Standards of Ethical Conduct, are proposed for amendment as a result of revisions to State Board of Education Rule 6A-10.081, Principles of Professional Conduct for the Education Profession in Florida, specifying that Florida educators shall not: (a) intentionally provide classroom instruction to students in grades 9 through 12 on sexual orientation or gender identity unless such instruction is required by state academic standards as adopted in State Board of Education Rule 6A-1.09401, or is part of a reproductive health course or health lesson for which a student’s parent has the option to have his or her student not attend; (b) violate Section 553.865(9)(b), F.S., which relates to entering restrooms and changing facilities designated for the opposite sex on the premises of an educational institution; (c) violate Section 1000.071, F.S., which relates to the use of personal titles and pronouns in educational institutions; or (d) discourage or prohibit parental notification of and involvement in critical decisions affecting a student’s mental, emotional, or physical health or well-being.

To Amend Board Policies 2111, Parent and Family Engagement - A Home-School-District Partnership, and 5330, Student Use of Medications, Policy 2111, Parent and Family Engagement - A Home-School-District Partnership, is proposed for amendment to incorporate the requirements of State Board of Education Rule 6A-10.089, School Sponsored Events and Activities (Aug. 22, 2023), and Policy 5330, Student Use of Medications, is proposed for amendment to comport with HB 1537 (2023) and to clarify that students are to be administered medication and/or treatment only in accordance with this policy. Policy 2111, Parent and Family Engagement - A Home-School-District Partnership, is proposed for amendment to incorporate the requirements of State Board of Education Rule 6A-10.089, School Sponsored Events and Activities (Aug. 22, 2023), which requires schools to notify parents of the details of school-sponsored events and activities and include these details on parent-permission forms. Policy 5330, Student Use of Medications, is proposed for amendment to comport with HB 1537 (2023) and to clarify that employees cannot distribute medications or administer treatments to students unless in accordance with this policy.

PURPOSE: The District Instructional Review Committees (DIMRC) will convene to present their recommendation for the adoption of instructional materials for the following courses:

The district-adopted programs will be implemented in the 2024-2025 school year pending School Board approval and adequate funding.

To Amend Board Policies Board Policies 3120, Employment of Instructional Personnel; 1121.01, Employment Standards and Fingerprinting; and 3121.01, 4121.01, Employment Standards and Fingerprinting of all Employees, to conform to SB 676 (2023), HB 5101 (2023), and amendments to Florida Administrative Code ("F.A.C.") Rule 6A-4.004, Florida Educator’s Certificates with Academic, Administrative, Degreed Career and Technical, and Specialty Class Coverages. Policy 3120, Employment of Instructional Personnel, is proposed for amendment to the validity period of a nonrenewable, temporary teaching certificate from three (3) years to five (5) years. Policies 1121.01, Employment Standards and Fingerprinting, and 3121.01, 4121.01, Employment Standards and Fingerprinting of all Employees, are proposed for amendment to delineate disqualifying factors for employment and to clarify that beginning January 1, 2025, employee eligibility requirements will be within the purview of the Agency for Health Care Administration.

To Amend Board Policy 8405, School Safety, as a result of HB 543 (2023) redesignating threat assessment teams as threat management teams. Additionally, HB 543 includes the requirement that the Superintendent designate a Threat Management Coordinator and report the name and contact information of the Coordinator to the Office of Safe Schools. Additionally, at least one (1) member of the Threat Management Team must have personal familiarity with the student who is the subject of the threat assessment.

To Amend Board Policies 5200, Attendance, and 8330, Student Information, Records, and Privacy Rights, to conform to an amendment to Florida Administrative Code ("F.A.C.") 6A-1.0955 (Aug. 22, 2023). Policy 5200, Attendance, is proposed for amendment to clarify that a court order is required for a legal name change to be effectuated and that an assumed or alternate name can be added to DSIS and certain school documents upon signed, written request. Policy 8330, Student Information, Records, and Privacy Rights, is proposed for amendment to allow parents to specify the use of any deviation from their child’s legal name in school.

To Amend Board Policy 2431, Interscholastic Athletics, as a result of legislative updates. Board Policy 2431, Interscholastic Athletics, is proposed for amendment pursuant to HB 225 (2023), which amends F.S. 1006.15 to allow eligible students who participate in an interscholastic athletic activity to join another public school’s interscholastic athletic activity or a private school’s interscholastic activity if the activity is not offered by their public school. The policy is also revised to allow eligible students to continue participating in their current school’s interscholastic athletic activity after transferring to a new school, and to allow students of certain non-FHSAA private schools to join the District’s own interscholastic athletic activities.

To Amend Board Policy 6320, Purchasing, as a result of HB 3 (2023) and to align the policy language with current District practices. Board Policy 6320, Purchasing, proposed for amendment as a result of HB 3 (2023) which prohibits the Board from requesting documentation of, or providing preference based on, the vendor’s social, political, or ideological interests. Additionally, the Policy is recommended for revision to align with current District practices.

A person wishing to appeal any decision made by The School Board of Miami-Dade County, Florida, with respect to any action on this policy should ensure the preparation of a verbatim record of the proceedings, including the testimony and evidence upon which the appeal is to be based.
