Tim Blood was three months from a May 23 class action trial against the makers of health supplement Joint Juice when he discovered his lead plaintiff had impersonated a lawyer in a separate case against exercise equipment manufacturer Peloton, then lied about it in a deposition.

A judge in the Peloton case on Jan. 19 found the conduct of Eric Fishon was “sufficiently serious” enough to toss him from the case. Weeks later, Blood, of San Diego’s Blood Hurst & O’Reardon, told the judge in his own case about the ruling, then sought to replace Fishon.
