The U.S. Department of Justice accused two trial court judges of substituting their views on science in place of medical experts in issuing preliminary injunctions against the Biden administration’s vaccine mandate for health care workers.

Judges Terry Doughty, of the Western District of Louisiana, and Matthew Schelp, of the Eastern District of Missouri, issued temporary injunctions against the Centers for Medicare and Medicaid Services (CMS) rule earlier this week, while a district judge in Florida last month rejected a request to block the requirement. All three decisions have been appealed to their respective federal appeals courts while the rule is on hold nationwide.
