Delray Beach was cleared of allegations that a farmers market at Old School Square Park created a dangerous condition.
In 2013, Joel Richard, 67, was helping a vendor at the Delray Green Market when he went to use a restroom. He found farmers’ vehicles parked on the paved path, so he walked in a grassy area. He claimed he fell, fracturing and dislocating his left hip. Richard argued the city negligently let vehicles on the paths, causing him to walk on unmaintained grass.
