Supermarket worker John Hoyt, of Waterbury, was unloading a shrink-wrapped pallet of loose dairy items when the load began to shift. Unable to get out of the way, he was pinned against the inside of a tractor-trailer and forced to the floor, injuring his spine.

Hoyt sued the company that shipped the items, C&S Wholesale Grocers, of Keene, N.H., along with the Shaw’s Supermarket chain. The injury occurred at the Shaw’s in Southbury, Conn. Hoyt alleged the 5-foot-tall load of dairy items was not safely stacked or stretch wrapped.
