The law in Connecticut is still developing around when a wrongful-death action can be brought on behalf of a fetus. While the Connecticut Appellate and Supreme courts have yet to weigh in, a Superior Court decision in the 2018 case Elderkin v. Mahoney held that a wrongful-death claim could be brought on behalf of a fetus that was 17 weeks.

Stamford Health Inc. was sued for wrongful death and medical malpractice after its physicians allegedly failed to diagnose a pregnant woman with appendicitis, resulting in a septic infection and death of her twins.
The case was brought by Silver Golub & Teitell on behalf of Johana Navarrete and Johan Rojas individually and the estates of their children.
