Walmart shareholders on Wednesday hurdled another obstacle in the Court of Chancery case where they are seeking to impose liability for the company’s role in the opioid pandemic, as Vice Chancellor J. Travis Laster decided the majority of claims passed the demand futility test.

Walmart, represented by Richards, Layton & Finger; Latham & Watkins; Sidley Austin and Hogan Lovells, was successful on getting one of three groups of claims dismissed: those that involved the company acting as a drug distributor under the Controlled Substances Act.
