The Biden administration is not required to enforce the Trump-era immigration policy that forces asylum seekers to remain in Mexico while their claims are being processed, a divided U.S. Supreme Court ruled Thursday.

Leading the 5-4 majority, Chief Justice John Roberts Jr. wrote that the Biden administration’s rescission of the Trump administration’s Migrant Protection Protocols did not violate the federal Immigration and Nationality Act, and its second termination of the policy was valid agency action. Roberts was joined by Justices Stephen Breyer, Sonia Sotomayor, Elena Kagan and Brett Kavanaugh.
