A federal judge in Connecticut has rejected Yale New Haven Hospital’s arguments against turning over additional documents to the U.S. Equal Employment Opportunity Commission regarding medical practitioners over age 70 who were allegedly “directed to submit” to neuropsychological and ophthalmological testing.

In 2016, YNHH adopted its “Late Career Practitioner Policy,” which requires medical practitioners over 70 years old to submit to such testing if they wish to be appointed or reappointed, in response to studies suggesting the effect of aging on the competence of physicians, according to a U.S. District Court for the District of Connecticut judge’s order filed Friday.
