Johnson & Johnson lost key initial fights in its attempt to stop talcum powder lawsuits from moving forward, but the battle is far from over.

In two orders Tuesday, U.S. Bankruptcy Judge Craig Whitley, who is overseeing this month’s Chapter 11 filing of newly formed LTL Management, refused to immediately side with Johnson & Johnson. He ordered LTL Management, which was created to absorb Johnson & Johnson’s talc liabilities, to show why its bankruptcy case should not be transferred to New Jersey from his courtroom in the Western District of North Carolina. He also refused to grant a blanket stay on all lawsuits.
