After signaling in a written order that she would stay the implementation of Purdue Pharma’s $4.3 billion bankruptcy settlement pending appeal, U.S. District Judge Colleen McMahon of the Southern District of New York on Tuesday declined to issue a ruling from the bench at the end of oral arguments, saying she expected to issue her decision Wednesday.

McMahon noted that the case may soon leave her jurisdiction for a higher court. U.S. Bankruptcy Judge Robert Drain, who approved the settlement in September, is set to hear a motion for direct certification of appeal to the U.S. Court of Appeals for the Second Circuit Thursday morning.
