Conservatives are raising concerns over the possibility of the Biden Justice Department reinstating a policy that would allow payments to go to third parties in settlements reached in government litigation.

Then-Attorney General Jeff Sessions halted the practice in 2017, in which a party involved in the government case would be required to make a payment to an outside organization to help settle the case. While conservatives referred to those payments as “slush funds,” they were subject to judicial review and were viewed as a way to help remediate damage done by the corporation targeted by the challenge.
