U.S. District Judge Gregory Woods of the Southern District of New York on Tuesday allowed a lawsuit related to Whole Foods Market’s house brand graham crackers to move ahead, rejecting the supermarket chain’s motion to dismiss claims that it violated New York state consumer protection law.

Attorneys from Sheehan & Associates filed the proposed class action lawsuit in February 2020, arguing that the Organic 365 Honey Graham crackers were “misrepresented as containing more honey and whole grain flour than sugar and non-whole grain flour,” according to the complaint.
