On Feb. 15, Kanye West tweeted to his millions of followers that his “album will never never never be on Apple. And it will never be for sale. … You can only get it on Tidal.” And yet the album, “The Life of Pablo,” is now available on Apple and Spotify. Was West’s broken promise legally binding? Experts say it could be.

As our affiliate The Recorder reported, influential plaintiffs lawyer Jay Edelson filed a class action lawsuit on Monday against West and S. Carter Enterprises, the company that owns Tidal, which is an artist-owned streaming service purchased by Jay Z in 2015. According to the complaint, as a result of West’s tweet, Tidal’s consumer subscriptions tripled from 1 million to 3 million in just over a month. Subscribers not only provided a credit card number to the flailing streaming service, but also their email addresses and social media account information.
